1. Agreement
These Terms govern your use of Spotter(the “Platform”), a marketplace connecting clients with independent personal trainers. By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
2. Eligibility
You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of the information you provide and for activity under your account.
3. Accounts & roles
Accounts may act as a client or a trainer. Trainers must provide accurate professional information and may be subject to review and approval before appearing in search. You are responsible for keeping your credentials secure.
4. The Platform is a marketplace
Spotter provides software that helps clients and trainers find each other, communicate, schedule sessions, and (optionally) pay. Spotter is not a party to the agreement between a client and a trainer, does not employ trainers, and does not provide training, medical, or health services. Trainers are independent contractors solely responsible for the services they provide.
5. Health disclaimer & assumption of risk
Personal training involves physical activity that carries inherent risks of injury. Content on the Platform is for general fitness purposes and is not medical advice. Consult a qualified healthcare provider before beginning any exercise or nutrition program. You participate in training and follow any program at your own risk and assume responsibility for your health and safety.
6. Payments & fees
Trainers may purchase subscriptions and may charge clients for sessions through the Platform. Payments are processed by Stripe; by paying or receiving payouts you also agree to Stripe’s terms. Spotter may charge a platform fee on in-platform session payments, disclosed before purchase. Subscription fees are billed in advance and are non-refundable except where required by law. Refunds for sessions are handled per the cancellation terms shown at the time of booking.
7. Bookings & cancellations
A booking is an agreement between a client and a trainer. Confirmation, cancellation, and completion are managed in the Platform. Canceling a paid session before it occurs may trigger a refund as described at booking.
8. Your content
You retain ownership of content you submit (messages, reviews, programs, documents, progress photos, measurements). You grant Spotter a limited license to host and display that content to the people you share it with in order to operate the Platform. Reviews must be honest and based on genuine experience.
9. Acceptable use
Do not use the Platform to harass, defraud, infringe others’ rights, circumvent fees, post unlawful content, or attempt to access data you are not authorized to see. We may suspend or terminate accounts that violate these Terms.
10. Disclaimers & liability
The Platform is provided “as is” without warranties of any kind. To the maximum extent permitted by law, Spotter is not liable for indirect or consequential damages, or for the acts, omissions, or services of trainers or clients.
11. Changes & termination
We may update these Terms; material changes will be posted here with a new date. You may stop using the Platform at any time. We may suspend or terminate access for violations or to comply with law.
